An AI can have a theory of mind, in fact would require something like this to interact with humans and can easily acquire an operative but not explicit one through deep learning but it cannot have a problem of other minds. This is because any knowledge it possesses as to its own possession of a mind is purely formal and not ontological. Grasping this problem in an ontological sense means that there is an original relation to being as ground. Insofar as all humans have the potential for such a relation and draw their deepest identity from it also follows that all humans have the same relation to being - this is entirely on the side of being and not the empirical individual. This is the ground of pure identity, as captured in the Vedantic, 'thou art that'.
